Charges Dropped Against 10-Year-Old Boy

KALISPELL – Flathead County prosecutors have dismissed a criminal endangerment charge filed against a 10-year-old boy afer a 7-year-old girl was shot in the stomach this summer.

Defense attorney Sean D. Hinchey says a psychological evaluation showed that Devon Brown of Marion was not competent to fully understand the charge against him and was unable to assist in his defense.

Brown was charged in Youth Court with shooting Kayla Oswald of Columbia Falls with a .22-caliber rifle in June. She suffered a ruptured blood vessel and damage to her pancreas, stomach and intestines. She spent nearly a month at Harbor View Medical Center in Seattle.

Authorities say the boy told them he accidentally pulled the trigger.
