A 22-year-old Evergreen man who killed a woman before shooting himself in the face will be re-sentenced after the state Supreme Court ruled the original term was not in line with a plea deal signed with prosecutors.
Kenton Weimer was sentenced to 40 years in prison after pleading guilty to mitigated deliberate homicide in the May 2007 shooting death of 18-year-old Tarisia Caron, also of Evergreen. District Judge Ted Lympus ordered him to serve 20 years of his prison term before becoming eligible for parole.
But Weimer’s defense attorney argued the agreement called for the state to seek a straight 40-year prison term and did not permit prosecutors to endorse parole restrictions. The Daily Inter Lake reported Friday that state Supreme Court Justice William Leaphart signed an order Aug. 17 vacating the sentence.
Weimer, who will be re-sentenced Jan. 12, shot Caron in the head in what authorities said was an apparent murder-suicide pact.
