MISSOULA — Jurors in the Missoula rape trial of Jordan Johnson heard testimony Friday from Brian O’Day, a friend of the alleged victim and son of former University of Montana athletic director Jim O’Day.
O’Day testified the woman gave him a ride home from a bar after the alleged incident in February 2012. During the ride and afterward, O’Day said, she told him what had happened in her apartment with Jordan.
O’Day said she appeared pale, The Missoulian reported Friday.
Days later, O’Day said, she texted him to say she planned to report that Johnson assaulted her.
Johnson, 20, a former UM quarterback, is charged with raping the woman as the two watched a movie at her home on Feb. 4, 2012. He insists the sex was consensual.
The trial is taking place amid NCAA and federal investigations into how the school and the city of Missoula respond to rape allegations on campus.
O’Day testified that several days after the alleged incident he asked the woman whether she thought Johnson had done anything wrong — or whether “you don’t think that he thinks he did anything wrong.” The latter, she responded, according to O’Day.
He also testified that she had told Johnson in her residence, “‘No, I don’t want to do this.'”
Jurors on Friday also heard testimony from Ali Bierer, a friend of the woman who took her to a center for sexual assault victims a day after the incident.
Claire Francoeur, a nurse practitioner at the center, gave much of her testimony Friday to jurors in a closed courtroom. The testimony included video of the woman’s physical exam.
On Thursday, the woman testified that Jim O’Day and UM football coach Robin Pflugrad were fired a few days after university officials interviewed her parents about the incident. University President Royce Engstrom has said only that he sought change. Pflugrad has linked the firings the Johnson case.
“I don’t know if she technically had anything to do” with the firings, Brian O’Day testified Friday, “but it might have resulted” from her reporting the incident.
