To grant the State it does not have; the power to dictate alcohol and/or smoking on its private premises, is nothing less than a total affront to the principles of liberty and the pursuit of happiness upon which these States were founded. I find it despicable and the MT Supreme Court ought to over rule this unjust and anti-ethical law.

missedyourmark, smoking can kill people, so can alcohol, cheeseburgers, sugar, and aspirin. That’s not the issue. The real issue is the states violation of private property rights. If a business wants to allow smoking, then that is their right. The government does not have the moral authority to set dictums on whether someone can or cannot smoke ON PRIVATE PROPERTY. You seemed obsessed with having the government control peoples lives and choices that are none of your business.

Another good consequence of the smoking ban.So Roark if its my property you say the state doesn’t have the right to tell me what I can do on it. What about the laws pertaining to selling alcohol and tobbaco within1000 ft of schools. Or where medical marjijauna can be sold. Its private property, not its own nation. You are reguired to follow all laws wether you agree with them or not. If you don’t like the law, follow the process and get it changed, otherwise its just anarchy.
