“To achieve this goal, Congress put in place a comprehensive scheme to regulate the movement of firearms in commerce,” the government lawyers wrote in their brief.”
So the Government lawyer ADMITS the governments plan is a “comprehensive scheme”.
Just that statement alone should be enough for people to realize that the people of Montana are smart enough to take care of their own and the Federal Gov’t should take their NAZI gun control legislation and shove it up their (insert proper metaphor here)..! ! !

By the way, Montana is one of 2 states in the U.S. that ALL OTHER states look to when modeling how to fight for their rights.
That’s why I moved here from the most FACIST, SOCIALIST state in the country…..........Washington State.
I wanted to be part of a community and state that still knows what the Constitution Of The United States of America stands for.

Well, as Gary Marbut says, “its on now”.
Yeah, MB, the fed will definitely dangle that funding carrot over the state to play hardball with - no question. While I do hope that this lawsuit bears fruit for the people of Montana, I have my doubts.
@JCW - I thought the most socialist state in the country is Massachusetts; at least in most of Washington state, you can own a firearm - try to own a handgun in Massachusetts or New York.

If something isn’t involved in interstate commerce the feds don’t have the privilege of regulating it.If they use the carrot and stick by withholding fed money to enforce unconstitutional laws don’t send them the money in the first place. They can’t withhold what they don’t have.If anybody is scared of freedom they need to crawl back into the socialist cesspool they swam out of.Long live the Constitutional Republic of Montana.

Fed law bans them if they can be “used readily and efficiently by criminals or gangsters.” It’s not about building and selling just in-state, it’s about keeping them there. Since bad guys will break the law, states can’t do anything that’ll help them, like no background checks etc…

DOJ moving to have this suit dismissed is just the opening shot across the bow. Here’s hoping that Marbut and company can take it as far as they can - we really need to take the fed to task on the issue of states rights.
