Welcome to the world of Michael Smith. The Healing Center is doing major harm with this grandstanding and skirting the law. Mr. Daubert represents the vast majority of patients and caregivers to err on the side of caution. I just pray that the law does not have to be written to defend the our State and its Citizens against tyrants like The Healing Center and Michael Smith.
He is skirting the law and spewing bad information. This is the way I interpret the law.
While a person not in possession of a card, but script only, may have a “defense” in court based on “affirmative defense” contained in the bill. However, and more importantly, it is not beyond potential prosecution. So the question is, do you want to be arrested? Hire attorneys? Defend yourself in court, and possibly take part in the “case law” that will form because of “your lawsuits” outcome. Does not sound like something I would advise my patients to do, but it is exactly what The Healing Center, and Michael Smith is advocating.
Go back to Colorado Mike and resume the problems you are causing there. Stop hurting the reputation of an incredibly valuable program.

Smoking on the steps of the civic center actually may have been illegal, because smoking medical marijuana in these places is prohibited:
(i) in a school bus or other form of public transportation;
(ii) on any school grounds;
(iii) in any correctional facility; or

I know next to nothing about the person but I do know what has happened to us here in EWA state with our collective. Someone placed an add on craigs list advertising our services…..normally not a problem except we did NOT place the add as we do not advertise. My point is just becuase you see an “add” on craigs list does NOT mean they wrote it. Resolution of this issue should not be framed as “problems”. Overall the entire tone of this article exudes an antagonistic cultural bias, and I would exhort Mr. Brown to exchange his vulgar propensities towards hemp to include a more impartial and well-researched perspective in his writings. I would not tolerate any journalist disparaging a racial minority based on negative stereotyping; referring to cannabis as “weed”, “pot” or even “marijuana” under the guise of objective dialogue should be held equally unacceptable.
So much fear still surrounds cannabis; there is yet no perceived safe arena for public consensus, so the topic remains relegated to the courtrooms or legislatures by default. Montanans must examine the benefits and liabilities this plant offers to their communities, and freely exchange ideas without concern of reprisal. I believe intelligent and reasonable discourse on the subject shall eventually lead to blanket decriminalization based on popular choice.
As for the law, the methods in which hemp is grown, sold and used should be governed by the counties and municipalities where such activities take place, and should be aligned with state regulations that protect its citizens from any recognized threat. Revenues could be generated from licensure, mandatory education, fines, and taxes. Outside of existing moral bias, does this issue really have to be so complex?

Now he is stating that people who take “pharmaceuticals” are “drug addicts”!! Is this guy really a caregiver for truly “sick” people with this kind of attitude? He must not be or he would know that the “pharmaceuticals” are what is keeping his patients “alive”. And “zoning” applies to the entire demographic of a city. No one is picking on medical marijuana. A few comments:
“off the sick and dying” - come on, the mmj program is exploding, and everyone and their brother is getting registered now. Let’s stop pretending this is all about cancer and AIDS, it’s about people figuring out a way to be protected from arrest. And if that’s the case, let’s drop “medical” altogether and treat marijuana like wine. Legal to create at home, age restrictions, advertising restrictions, taxed, and zoning restrictions.
“ordinance restricting caregivers in the city limit to only 3 patients” - that’s not what’s being contemplated. It’s a business classification zoning ordinance, and it’s temporary.
Non-profits: non-profits can make millions and millions every year. They just can’t distribute profits to shareholders. They can take fat salaries though. And The Healing Center is not set up as a public interest charity, but rather a nonprofit corporation which benefits its members, like a social club or fraternity. A small distinction.

We are aware that the said they would zone us into medical corridor.

As it stands right now the city of whitefish has made a law saying clearly you CAN NOT care give for more than 3 patients in the city limits or a 1 mile radius.
As a Side note most of my patients are over 40 with REAL issues.

This it what it actually says.
So if you care give for 4 patients or more, you are now illegal as per the city of Whitefish.

Health Sciences Group, Inc. (PINKSHEETS: HESG) would like to announce that it is in strong negotiations to acquire a minority stake in two separate Montana-based marijuana growing, distribution and care giving operations.
“This is part of our strategy, acquiring existing operations as well as starting new operations. We feel that the profits in Medical Marijuana are in growing and transportation of marijuana,” states Thomas Gaffney, CEO of Health Sciences Group.Gaffney continues, “We are still working with Medical Marijuana, Inc. on doing business in California and we are also exploring operation businesses in Colorado.”
The deals would more or less be partnerships. HESG would fund the operations for expansion and growth of the existing business. The negotiations are moving quickly and we expect them to close no later than the end of December 2009 or the first of the year.
“With these acquisitions, HESG would be the first public company with actual operation of a Medical Marijuana business,” states Gaffney. “Once the preliminary documents are decided and signed we will announce the names; until then we are keeping the names of the Companies under wraps. The public can expect the names of the companies to be exposed by the middle of next week.”
In the State of Montana you must be licensed as an actual caregiver to grow marijuana. Combined, each of these operations have approximately 100 patients combined.

INITIATIVE NO. 148
(2) “Department” means the
department of public health and human services. (3) “Marijuana” has the
meaning provided in 50-32-101. (4) “Medical use” means the acquisition,
possession, cultivation, manufacture, use, delivery, transfer, or
transportation of marijuana or paraphernalia relating to the
consumption of marijuana to alleviate the symptoms or effects of a
qualifying patient’s debilitating medical condition. (5) “Physician”
means a person who is licensed under Title 37, chapter 3. (6) (a)
“Caregiver” means an individual, 18 years of age or older who has
agreed to undertake responsibility for managing the well-being of a
person with respect to the medical use of marijuana. A qualifying
patient may have only one caregiver at any one time.
(b) The term does not include the qualifying patient’s physician. (7)
“Qualifying patient” means a person who has been diagnosed by a physician
as having a debilitating medical condition.

Montana Medical Marijuana ActINITIATIVE NO. 148
NEW SECTION. Section 1. Short title. [Sections 1 through 9] may be cited as
the “Medical Marijuana Act”.
NEW SECTION. Section 2. Definitions. As used in [sections 1 through 9], the
following definitions apply:
(1) “Debilitating medical condition” means: (a) cancer, glaucoma, or
positive status for human immunodeficiency virus, acquired immune
deficiency syndrome, or the treatment of these conditions; (b) a
chronic or debilitating disease or medical condition or its treatment
that produces one or more of the following:
(i) cachexia or wasting syndrome;(ii) severe or chronic pain;(iii)
severe nausea;(iv) seizures, including but not limited to seizures
caused by epilepsy; or(v) severe or persistent muscle spasms,
including but not limited to spasms caused by multiple sclerosis or
Crohn’s disease; or
(c) any other medical condition or treatment for a medical condition
adopted by the department by rule. (2) “Department” means the
department of public health and human services. (3) “Marijuana” has the
meaning provided in 50-32-101. (4) “Medical use” means the acquisition,
possession, cultivation, manufacture, use, delivery, transfer, or
transportation of marijuana or paraphernalia relating to the
consumption of marijuana to alleviate the symptoms or effects of a
qualifying patient’s debilitating medical condition. (5) “Physician”
means a person who is licensed under Title 37, chapter 3. (6) (a)
“Caregiver” means an individual, 18 years of age or older who has
agreed to undertake responsibility for managing the well-being of a
person with respect to the medical use of marijuana. A qualifying
patient may have only one caregiver at any one time.
(b) The term does not include the qualifying patient’s physician. (7)
“Qualifying patient” means a person who has been diagnosed by a physician
as having a debilitating medical condition. (8) “Registry identification
card” means a document issued by the department that identifies a person as
a qualifying patient or caregiver. (9) (a) “Usable marijuana” means the
dried leaves and flowers of marijuana and any mixture or preparation of
marijuana.
(b) The term does not include the seeds, stalks, and roots of the plant.
(10) “Written certification” means a qualifying patient’s medical records
or a statement signed by a physician stating that in the physician’s
professional opinion, after having completed a full assessment of the
qualifying patient’s medical history and current medical condition made in
the course of a bona fide physician-patient relationship, the qualifying
patient has a debilitating medical condition and the potential benefits of
the medical use of marijuana would likely outweigh the health risks for the
qualifying patient.

For the record, I haven’t seen anyone here naysay medical cannabis usage. It seems we all agree on that point. Please correct me if I am wrong, because I have read all the comments (some of them more than once), and still don’t understand what all the shouting is about.
To make a request, the guidelines offered by the editor used the word “civil”, and I don’t see much civility in these comments. Unless we have fundamentally antithetical perspectives on the bigger issue, we shouldn’t be barking so ferociously over a difference in strategies. Please eliminate the inflammatory rhetoric, as it only serves to convince the opposition that what they believe is correct.
Now, is there any way to get back to some intelligent dialogue? Jack made a very good point about people using the law to register themselves solely for legal use. How much is this actually happening and could it be harmful to cannabis’ perceived legitimacy if state lawmakers feel the law is being abused?

Patriot- You are correct. The reason for this is Michael Smith. He has placed himself at the forefront of medical marijuana. He speaks as if he represents the patients and caregivers. If we do not disagree with him with vigor, the readers will come to the conclusion that we are all like Michael Smith.
The reasons for our outrage are as follows.
The Healing Center and Michael Smith;
-You have attacked local governments.
-You have attacked other caregivers, publically, and unprovoked. Mr. Daubert had an excellent article in the paper. It had a strong positive message. You then did an interview in the Great Falls Tribune telling Mr. Daubert, one of the writers of the law, that everything he says is incorrect.
-You represent the law in a manner inconsistent with the interpretation of the Lewis and Clark County Attorney, and go on the record stating you will sell to people without the card regardless of his “opinion”.
-You are, or will be, suing multiple local governments. These are funded by taxpayers. You are costing the Citizens of Montana money. You have threatened numerous others.
-You are causing the only news on medical marijuana, to be bad news. All over the State of Montana.
The reason for this debate is the sustainability of this law in the face of adversity. This was self induced by Michael Smith himself, and not necessary. His combative attitude will draw more and more bad publicity as we see here.
And for the record. This is NOT JASON CHRIST. I assure you. Call him and ask. I bet you get a big surprise. Besides, I do not think Jason would support Tom Daubert. I do. He is the positive tone and the spokesman of the business in my opinion.
I will continue publically disagreeing with Michael Smith until he no longer is in the headlines. He makes all patients and caregivers look disingenuous. Let us make some positive news for medical marijuana. This will only be possible if Mike will stop the madness.

Funny how you support an owner in a FOR PROFIT dispensary. Montana cannabis as stated in Great Falls Tribune.Can only assume you are part of that group.But attack a NON PROFIT,
I have never attacked any other legitimate caregiver,,as you state,,,more of your skewed view.
Thats right I will litigate for the rights of patients including me, my son and all others.

I am a taxpayer as well.
We are providing relief to patients all over the state in a well lit safe secure location.
We are open in Lewis and Clark county and it is the busiest location in the state, the capitol!
You continue to spew untruths about our group.

You will not ruin the face of the Montana Medical Marijuana Program. We will not tolerate it.
Bottom line is you can call it what you want. As long as you keep providing such excellent ammunition in the form of untrue statements and positions founded in greed, I will continue. I will be here. Making you defend yourself and the damage you are so blatantly causing. In the background. Slamming your moves. Keeping you up at night. Occupying your whole Sunday. Being in your mind.
