Joe Brenneman versus either, Howard (hey you kids get outta my yard) Gipe, who is something like a 120 years old, or Pam (sell all federal and state land ) Holmquist who doesn’t even live in the right district to run, and is one of the staunchest ADM members around.
Things are really starting to look up. A few weeks ago I was a little worried, starting to get some faith back. Democrats are starting to show they do have backbones and Obamas getting back to where he was when he got elected. No more trying to work with the republicants on health care, gonna push it through with a public option by process of reconcilliation. Even Tester is on board with it now. All we gotta do is get Mr. wimpy( Baucus) to go along with it and its a done deal.
Yeah the futures so bright I’m gonna hafta where sunglasses.

Thank goodness Joe is stepping up to this thankless job again.  I’ll be sending in my campaign contribution and suggest that, if you’ve been reading the commissioner blogs on this website and are disgusted by Taz, Alice, Thornton, and the other rabid ultra right wingists, you do too.  In fact, let’s get him a campaign manager who knows the tactics of the opposition.  How about a televised debate?  Does someone have a connection with our TV stations?  They must be good for more than reporting the weather.  If anyone on this blog knows where to send contributions, let’s hear it.  It’s time this valley operates on a more sophisticated level, where ideas are debated and candidates evaluated based on their vision for the Flathead rather than letting ignorance prevail.  We have a window to bring balance to the commissioners’ office.  Property rightists want all the rest of us to go away or remain uninvolved.  Only good can come of mounting an equal and balancing voice here.  It’s time.  It’s important.  It’s necessary.

The interesting thing about the Bush disaster was the total disregard for individual freedom, civil rights and states rights.  Isn’t it strange that the people here condemning Bush cheer for the end of property rights?  Meanwhile supporters of property rights on this cite cheer for the administration which in recent time has most injured state and individual rights and appointed 2 justices to the supreme court that actually have poor histories of supporting property rights.

Funny how we seem to step on ourselves based on the moments urge to rant. Joe good for you for running.  But please Joe quit acting superior to the rest of us. Be the good civil servant you could be.

So Alice four years ago Holmquist ran in the sourthern district of Flathead County, this year she running in the North-east district. She hasn’t moved, so did she run in the wrong district 4 years ago, or is she just moving her address to accomadate running. If she loses, in 2 years she can run in the north-west district. I would have liked to see if you actually kept a straight face when you wrote that she doesn’t belong to ADM. I hope you make better tacos than the baloney you just put out.

There is no membership list except for the ones Crowder and Thompson keep. A very secretive group ADM is, if I believed in conspiracy theories I’d think they were hiding something. We all knew the three million dollar man would file after he voted the settlement down and not before.  I’m surprised he has the courage with what he has done to this county on North Shore alone.  Be real interesting to read his deposition and see just why the county needs to settle.  Joe also is going to have to explain why his property got left out of the FEMA maps.  Hmmmmm, wonder how that happened Joe?

Did you know several decades ago the EPA adopted a regulation that required farmers to post notices on their pasturelands stating that cows should not defecate within twenty feet of a flowing stream?

Seems they didn’t have a clue that cows couldn’t read the signs.

Knowing many farmers and ranchers in the valley, I think Alice is insulting most of them. My wifes family dairy farms in another area, they work very long hours on the farm and then spend many more hours on the business end of it. To act like family agriculture is not a business is just ignorance.

Couple of points, followed by a couple more.

From 1900 to the present time, Flathead County population has grown by approximately 2.7% per year on average. The rate changes year by year, up or down, but is actually quite consistent.  Every time there’s an up trend, people think it’s the beginning of the end.  Two things happen. One, people start making rash predictions that our population will double in ten years.  They’re always proven wrong. Two, people start subdividing property like crazy.  A lot of them go bankrupt in the process.

Population growth and subdivision activity have very little to do with who is in the Commissioner’s office.  It has a whole lot more to do with two novel ideas.  First, people move here. They want a place to live.  So they shop around, find something they like, and either rent or buy.  On land some dastardly developer subdivided once upon a time.  Second, they have babies, who grow up to be young men and women, some of whom shop around, find something they like, and they either rent or buy.  On land some other dastardly developer subdivided once upon a time.

In 1972, the state legislature mandated every city and county adopt Subdivision Regulations.  Mandated, not optional.  Zoning is still optional.  Floodplain Regulations were also put in place, as were Sanitation Regulations.  The way it works, if you have a piece of property and you can meet a) the Subdivision Regulations, b) the Zoning Regulations, c) the Floodplain Regulations, and d) the Sanitation Regulations, you can subdivide your property.

If you don’t like subdivisions in certain areas of the county, there are a couple of ways to handle it - 1) buy the property and lock it up, or 2) change one or more of the body of regulations that pertain to the division of land so that kind of land can’t be subdivided anymore.

Trouble with that is that you begin to edge into playing games with equal protection under the law – that means that you cannot restrict land development on one side of a road when you’ve already approved development on the other side of the road.  It also means that if any of you value your own property rights, then you have to value everyone’s property rights. 

And by the way, Expressed Public Opinion was removed by the state legislature decades ago as a criterion upon which approval or denial of a subdivision could be based.  So subdivision approval or denial is no longer based on opinion, but quantifiable criteria instead.

Bottom line is, if ANY Commissioner of either political party follows the laws and regulations that are in place, they will have very little effect on the proliferation of subdivisions in our county - that issue is driven by the marketplace and the laws and regulations which govern that activity.  And the Commissioners job is not to keep property developers from going bankrupt, nor is it to guarantee they will make money.

Alice and Taz, a month or so ago we were all discussing the pre-release center and you were so absolutely against that.  What would your thoughts be if they were trying to put that out at North Shore Ranch? Or if it were the new city airport?  To me, is seems property rights are property rights.  I guess the reason I am so opposed to the NSR is because of all the other half finished, half empty sub divisions in the valley and the fact that they never should be built on a swamp.  If somebody in your family wanted to buy one of those homes, in good faith, would you support them?  Just wondering….

Prerelease Centers and property rights are two seperate issues and I’m not sure why you are trying to link the two together.
We oppose prerelease centers period. We opposed the prerelease center south of Kalispell and we opposed the prerelease center in Evergreen and we oppose a prerelease center in the North Valley. We never opposed the landowners, only the facility.

Just trying to prove a point in a round about way.  I am not against the property owners.  I am against another piece of ground being paved over, built up and almost abandoned, like so many others sitting in the valley right now.  You are against a prerelease center.  If we go by PROPERTY RIGHTS and what is legal, instead of common sense ALL of the time, we would both be very unhappy, right?

I hear a lot of rancor toward and outright denigration of anyone who defends property rights. I’ve said it before, but it bears repeating.  These anti-property rights tirades are getting tiresome. 

Those property rights are what sets America apart from any society ever to exist. Those property rights are why even many ‘poor’ people in America are wealthier than most of the people in the world.

Rather than verbally crucify property rights proponents, some of you need to stop and think through the consequences of what you are saying.

One of your Bundle of Property Rights is the right to exclude anyone you want from your property.  That’s why the police have to get a warrant to search your property - and if they fail to do so, the ACLU is among the first to file a lawsuit against the violation of this property right.  I’m guessing most of you want to keep that property right.

I’m also guessing most of you don’t want to come home from work one day, only to discover that your house is now an army barracks.  Government can take property, but they have to justify it and pay for it.

And then there’s the odd burglar that likes to break in and steal your stuff.  If you have no right to prevent people from entering your property, you really have no right to gripe if they ‘borrow’ a few items if they visit when you’re not home.

One of your property rights is to utilize your property for an economically viable use.  Doesn’t matter if you’ve owned the property for a hundred years, or bought it just last week.  Suppose decide to sell your inherited farm land as development property.  You sell it to Smith & Jones for its market value, and life just got easier for your family. Selling your property is, by the way, another of your Bundle of Property rights.

But if the government had decided your property was nice as open space, and they arbitrarily and capriciously prevent it from ever being subdivided, you couldn’t have sold it for nearly as much.  Your property rights would also have been violated by that action.

I’ve only one question to ask those of you who voice your anti-property rights viewpoints - WHICH PROPERTY RIGHTS ARE YOU WILLING TO GIVE UP YOURSELF?

YOUR right to exclude others?
YOUR right to an economically viable use?
YOUR right to sell your property?
YOUR right to be compensated if the government takes your land?

So, WHICH ONES ARE YOU WILLING TO GIVE UP?

I suspect that many of you will decide that you really don’t want to give up YOUR property rights. But it seems you’re ready to give up someone else’s property rights, and if he or she gripes about it, they’re property rights kooks! 

Particularly when it comes to guys like Crowder.  So it’s OK to diminish his property rights, eh?  After all, that would be for the ‘common good’, wouldn’t it?

Unless you’re willing to give up your own property rights, all of them, then you have to value and defend everyone else’s property rights.
