I as a Canadian Citizen did not have a say in whether we should or should not keep the death penalty, I know of no one else hwo had either. This decision was made by our Bleeding Heart Government at the time.
I fully support the decision our present Government in not intervening in any cases as such for those convicted in a Democratic Country. 
I further believe that people who kill in coldblood as did Smith, and in this case there is no doubt of the event having taken place by the person convicted and he [they] should be executed.
